1. Agreement to These Terms

These Terms and Conditions (“Terms”) govern your use of the Our Home Hands website, service-request process, provider application process, communications, and related services. By using the website or submitting information, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the website or services.

2. Our Role

Our Home Hands operates a local request-routing and provider-matching platform. Unless expressly stated otherwise, Our Home Hands does not itself perform the home services requested through the website.

Service providers are independent businesses or professionals, not employees, agents, partners, or representatives of Our Home Hands. A match or introduction is not an endorsement, warranty, or guarantee of availability, qualifications, licensing, insurance, pricing, conduct, or results.

3. Eligibility and Accurate Information

You must be at least 18 years old and legally able to enter into an agreement. You agree to provide accurate, current, and complete information and to update it when necessary.

You may not impersonate another person, submit fraudulent requests, misuse contact information, interfere with the website, or use the services for unlawful, unsafe, abusive, or discriminatory purposes.

4. Service Requests and Matching

Submitting a request does not guarantee that a provider will be available, accept the request, arrive at a specific time, or complete the requested work.

You are responsible for describing the job accurately, disclosing hazards or special conditions, providing lawful access to the property, securing pets, and ensuring a reasonably safe work environment.

We may decline, pause, reroute, or cancel a request when appropriate, including for safety, capacity, suspected fraud, incomplete information, or service-area limitations.

5. Quotes, Pricing, Payments, and Cancellations

Unless otherwise stated, prices, estimates, payment terms, deposits, materials, cancellation fees, refunds, and warranties are established between the customer and the independent provider.

Before work begins, customers and providers should confirm the scope, price or pricing method, materials, timing, payment method, cancellation terms, and any warranty. Our Home Hands is not responsible for unauthorized work, price changes, payment disputes, chargebacks, or collection matters between users and providers.

If Our Home Hands directly collects a fee, the applicable amount and refund terms will be disclosed before payment.

6. Service Partner Requirements

Provider applicants must submit truthful information and maintain all licenses, permits, registrations, insurance, equipment, training, and qualifications required for their work.

Approval is discretionary and does not guarantee leads, revenue, territory, or a minimum number of opportunities. Providers may decline opportunities but must communicate promptly and professionally.

Providers are solely responsible for their employees, subcontractors, taxes, payroll, insurance, tools, vehicles, safety, quality, legal compliance, estimates, contracts, and customer obligations.

7. Communications

By submitting contact information, you authorize us and, where necessary, a matched provider to contact you about the request or application by email, telephone, or text message. Consent to receive operational messages is not a condition of purchasing unrelated services.

You may opt out of promotional email or text messages using the provided instructions, but you may still receive non-marketing communications related to active requests or obligations.

8. User Content and Photos

You retain ownership of content you submit. You grant Our Home Hands a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and share that content as reasonably necessary to operate, secure, and improve the services.

You confirm that you have the right to submit the content and that it does not violate privacy, intellectual-property, or other rights.

9. Intellectual Property

The website design, branding, text, graphics, software, and other materials owned by Our Home Hands are protected by applicable intellectual-property laws. You may use the website only for personal or legitimate business purposes connected to the services.

10. Disclaimers

THE WEBSITE AND MATCHING SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR HOME HANDS DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted website operation, provider availability, customer suitability, service quality, background-screening results, estimates, timing, or outcomes. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR HOME HANDS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, SERVICE DELAYS, PAYMENT DISPUTES, OR ACTS OR OMISSIONS OF CUSTOMERS OR INDEPENDENT PROVIDERS.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid directly to Our Home Hands for the relevant platform service during the preceding six months or $100, unless applicable law requires a different result.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Our Home Hands and its owners, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the services, your content, your violation of these Terms, or your acts or omissions.

13. Suspension and Termination

We may suspend or terminate access, remove content, decline applications, or stop communicating requests when we reasonably believe there is fraud, abuse, danger, repeated poor performance, nonpayment, legal risk, or a violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally.

Any court proceeding that is not required by law to be brought elsewhere will be brought in a state or federal court located in Minnesota. Nothing in this section limits rights that cannot legally be waived.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless a later date is stated. Continued use after the effective date constitutes acceptance of the revised Terms.
